Is there a time-frame legally that a landlord must wait before filing a dispossessory warrant?
Rent is considered on time between the 1st-3rd of every month according to the lease and the 4th date it is late with 10% additional to rent. I did not get the rent into the office before the 4th this month for June because I had a light surgery that I am still kind of recovery from so that next morning on the 5th of June at between 8a.m.-9a.m. must have been, a notice was posted that a 10% fee had been added plus it was rationally mentioned that if the rent along with the 10% wasn’t paid in 3 days that they were going to file a dipossessory warrant. This was the first time being late. This is a large property management company in Atlanta, Georgia with properties in almost half the U.S.A so this isn’t a small landlord where you can sit and talk face to face and work out a deal. I will have all the rent definitely on June 11th Wednesday because my work hours were shorten due to the surgery and therefore my check was shorten so what really is the best option for this situation?
Unfortunately there is little that can be done. If you don’t pay by the given dates, they will charge you and file with the courts. You can make arrangements to pay into the court system after they have done so, but it will include the cost of filing the action (aroung $300) plus the rent and 10% fee. If you can pay all that before your court date, then you won’t have to go to court over it and won’t be evicted. Otherwise they will seek eviction and they give you 14 days from the court date, but if you show for the court date, to vacate. If you don’t go, they can immediately put you out.
